Late on June 23, 2025, the U.S. House of Representatives passed H.R. 2808—known as the Homebuyers Privacy Protection Act—by unanimous voice vote, following the Senate’s unanimous consent approval of its companion bill, S. 1467, less than two weeks earlier nationalmortgageprofessional.com. This bipartisan legislation, championed by Reps. John Rose (R-TN) and Ritchie Torres (D-NY) in the House and Senators Jack Reed (D-RI) and Bill Hagerty (R-TN) in the Senate, will curb the abusive “trigger lead” practice—where credit bureaus sell your credit pull to third-party marketers—while still allowing your trusted lenders and Realtors to see your report when you’ve invited them to help you find the right loan congress.gov.

Why This Matters for Your Credit Report

  • Greater Control & Privacy: Once signed into law, H.R. 2808 will prohibit credit agencies from sharing your mortgage-related credit report unless you explicitly consent or the party has an existing relationship (e.g., your current lender) congress.gov.

  • Fewer Unwanted Calls: No more endless calls or emails from uninvited lenders hawking offers the moment you apply for pre-approval.

  • Confidence to Shop: You can authorize your Realtor or mortgage loan officer—like me—to pull your report without fear of “leakage” to unknown parties.

Tips for Realtors & Loan Officers

  1. Educate Your Clients: Explain how they can order free annual credit reports at annualcreditreport.com and set up fraud alerts or freezes if they wish mba.org.

  2. Obtain Proper Consent: Always get written or recorded permission before pulling a client’s credit—this practice will soon be mandatory by law.

  3. Leverage Pre-Approvals: Use soft-pull options when possible to protect privacy, and reassure clients that you won’t trigger unsolicited marketing.

Action Steps for Homebuyers & Homeowners

  • Review & Correct: Pull your credit from all three bureaus (Experian, TransUnion, Equifax) and dispute any inaccuracies promptly.

  • Monitor Regularly: Consider credit-monitoring services or free score trackers, especially if you plan to shop multiple lenders.

  • Partner Wisely: Work with Realtors and loan officers who follow best practices for consent-based credit pulls—this ensures privacy and smooth transaction flow.
